Business Visa

Subclass 132

Business Talent (Permanent) visa

This is a permanent visa that requires you to establish a new or develop an existing business in Australia.

To be Eligible:

  • Personal Net Value of at least AUD$1,500,000 (lawfully acquired and available for transfer into Australia within 2 years of visa grant)
  • Your current “Qualifying Business(es)” must, for 2 out of last 4 years, have:
    • Annual Business Turnover of at least AUD$3,000,000
    • Your net ownership in Business of at least AUD$400,000
  • Demonstrate successful business history
  • Age limit of 55 y.o. (can be waived by State)
  • No minimum English requirement (but higher application fee)
  • You must be nominated by a State or Territory
  • You must invest in and undertake daily management of “eligible business” within 2 years from visa grant. 

Subclass 188A

Business Innovation and Investment (Provisional) visa (subclass 188)

Business Innovation stream

This provisional visa (4 years) that requires you to operate a new or existing business in Australia.

To be eligible:

  • Point Tested – You must score at least 65 points  (based on your age, English competency, qualification, total net assets, business or investment experience, etc).
  • You and/or your partner combined must have total net business and personal assets of at least AUD$800,000. Your funds must be available to transfer to Australia within 2 years from visa grant
  • Your current “Qualifying Business(es)” must, for 2 out of last 4 years, have:
    • Annual Business Turnover of at least AUD$500,000
    • Your ownership interest in the business must be at least:
      • 51%, of the total value of the business if the business has a turnover of less than AUD$400,000 per year
      • 30%, of the total value of the business  if the business has a turnover of AUD$400,000 or more per year, or
      • 10%, of the total value of the business if the business is operated by a publicly listed company.
  • If your business provides professional, technical or trade services, you must have spent less than half your time providing those services, rather than general management of the business.
  • Age limit of 55 y.o. (can be waived by State)
  • No minimum English requirement (but have to pay higher application fee)
  • You must be nominated by a State or Territory.

You may convert to a PERMANENT VISA if you have satisfied the requirements for Subclass 888A – Business Innovation stream.

Subclass 888A

Business Innovation and Investment (Permanent) visa (subclass 888)

Business Innovation stream

This visa allows you to stay in Australia permanently

From you subclass 188A visa, you may convert to this permanent subclass 888A visa if:

  • For the 2 years immediately before you apply, you have:
    • had, and continue to have, an ownership interest eligible business(es) in Australia
    • had a direct and continuous management role in that business(es)
    • ownership interest in that business(es) of at least:
      • 51% of the total value of a business with a turnover of less than AUD$400,000 per year, or
      • 30% of the total value of a business with a turnover of AUD$400,000 or more per year, or
      • 10% of the total value of a business that is operated by a publicly listed company.
  • For the 12 months immediately before you apply: 
    • Your business(es) had an annual turnover of at least AUD$300,000
    • You and/or your partner must show at least 2 of the following:
      • assets of AUD$200,000 net value in your main business(es) in Australia;
      • personal and business assets in Australia of AUD$600,000 net value; and
      • equivalent of at least 2 full-time eligible employees (citizen or permanent resident of Australia, or New Zealander) in your main business(es).
  • You satisfied the residence requirement of being in Australia for 1 year out of the last 2 years. 

Subclass 188B

Business Innovation and Investment (Provisional) visa (subclass 188)

Investor stream

This provisional visa (4 year) requires you to invest at least AUD$1,500,000 for 4 years in the treasury bond of your nominating Australia State or Territory.

To be eligible:

  • Point Tested – You must scoare at least 65 points (based on your age, English competency, qualification, total net assets, business or investment experience, etc). 
  • For the past 2 years, you and/or your partner must have total net assets of at least AUD$2,250,000 million.  These assets must have been lawfully acquired and be available for transfer to Australia within 2 years from visa grant.  
  • You must have managed a qualifying business or investments to the value of at least AUD1.5million.
  • For at least 1 of the past 5 years, you have directly managed one of the following:
    • a “qualifying business” in which you and/or your partner combined had at least 10% ownership interest, or
    • a eligible investment of at least AUD$1,500,000 million owned by you and/or your partner combined.
  • You must:
    • have at least 3 years’ experience managing one or more qualifying businesses or eligible investments
    • have a successful record of eligible investment or qualifying business activity
    • have demonstrated a high level of management skill in relation to the eligible investment or qualifying business activity
  • Age limit of 55 y.o. (can be waived by State)
  • No minimum English requirement (but have to pay higher application fee)
  • You must be nominated by a State or Territory.

You may convert to a PERMANENT VISA if you have satisfied the requirements for Subclass 888B – Investor stream.

Subclass 888B

Business Innovation and Investment (Permanent) visa (subclass 888)

Investor stream

This visa allows you to stay in Australia permanently. 

From you subclass 188B visa, you may convert to this permanent subclass 888B visa if:

  • You must have held your investment  in the treasury bond of your nominating State or Territory for at least 4 years.
  • You must have lived in Australia for at least 2 of the past 4 years. 
  • You must have a realistic commitment to continuing your business or investment activities in Australia.

Subclass 188C

Business Innovation and Investment (Provisional) visa (subclass 188)

Significant Investor stream

This provisional visa (4 years) requires you to make complying significant investment of at least $5,000,000 for 4 years. 

To be eligible:

  • You must make a “complying investment” of at least AUD$5,000,000 and have a genuine intention to hold that investment for at least 4 years.
  • The “complying investment” must be invested in the following proportions:
    • at least AUD$500,000 in venture capital and growth private equity funds which invest in start-ups and small private companies.
    • at least AUD$1,500,000 in approved managed funds. The managed funds must invest in emerging companies listed on the Australian Stock Exchange.
    • a ‘balancing investment’ of at least AUD$3,000,000 in managed funds.
  • You must not use investments as security or collateral for a loan.
  • No age limit.
  • No minimum English requirement (but have to pay higher application fee).
  • You must be nominated by a State or Territory.

You may convert to a PERMANENT VISA if you have satisfied the requirements for Subclass 888C – Significant Investor stream.

Subclass 888C

Business Innovation and Investment (Permanent) visa (subclass 888)

Significant Investor stream

This visa allows you to stay in Australia permanently. 

From you subclass 188C visa, you may convert to this permanent subclass 888C visa if:

  • You and/or your partner must for the whole period during which you held your Subclass 188C visa have held a “complying investment”.
  • Either
    • a ‘balancing investment’ of at least AUD$3,000,000 in managed funds.
    • Your partner must have been in Australia for at least 720 days cumulatively over the 4 years which your partner held the Subclass 188C visa. 
  • You must have a realistic commitment to continue your business or investment activity in Australia.
